Part of me wants to keep digging into this, but only from a game design perspective. I should let the dust settle a bit more before I do that, though.
The problem with that is Zinger didn't take this game seriously from a design standpoint. In a more serious setting the die hard ability would probably be restricted to out of mylo situations, resulted in a no lynch instead, or possibly been more versatile in just making the top votee not lynched instead of JDCD specifically allowing for use as a framing ability.
